It's possible to break out of your Verizon Wireless contract in the next 60 days without paying an early termination fee because they're increasing the "regulatory fee" they charge customers from $.13 to $.16. This is what is known as a "materially adverse change of contract" and by standard contract law, it renders the contract void if one of the parties doesn't like the change.

First you'll want to bone up on what materially adverse change of contract means. Basically you signed a contract to get a given service at a given price, and after you signed it, they made it cost more. It doesn't matter if it's $50, a penny, or in this case, 3 cents. It's still materially adverse.

Then you'll have to call up Verizon and ask to be transferred to the retentions department. There you will pitch your case that this fee is a materially adverse change of contract, it voids the contract, and you demand to be let out of your contract without paying an early termination fee.

If they offer you freebies, turn them down. If they ask you if there is any other reason whatsoever, like your satisfaction with the service or the quality of it, that is making you leave, say no. Be single-mindedly focused on how this fee increase is the reason why you want to leave. And don't be scared. Despite its important-sounding name, the "Regulatory fee" is not charged by the government, it's just another fee Verizon assesses.

The reps may argue with you, they may tell you information that is not accurate, they may give you the runaround. Sometimes they're misinformed, other times they're just under extreme pressure not to let anyone leave without paying the toll. Don't be afraid to hang up and try someone else or escalate to a supervisor.

Worst comes to worst and they refuse to abide by standard contract law, you can take them to small claims court.

You only have 60 days from July 1st to make the cancellation because after that it is assumed that you have accepted any change to the contract.

Ditch Your iPhone

With the first wave of iPhone contracts expiring in June, consumers have plenty of other options.

Imagine a smart phone that worked on only one carrier's network. Now add in the cost of a wallet-draining $20 monthly data plan. The thing has no keyboard, and you can't even swap out the battery if you're on the road and want to keep on talking without stopping to charge up.

You don't have to imagine it--it's been here since 2007, and it's called the iPhone. In fact, if you were among the first to buy the original iPhone in June 2007, your two-year contract is almost up. Sure, you could buy the upgraded version, the iPhone 3G, and sign up for a new two-year contract if you're willing to shell out $199 for the phone and another $30 a month for the data plan. But guess what? It's now "the future," and you've got options.

The iPhone 3G is one heck of a phone, to be sure. It's a first-rate digital media player; it can handle e-mail and light Web surfing--oh, and you can use it to talk to people, too. And, thanks to Apple's (nasdaq: AAPL - news - people ) App Store, it's almost infinitely customizable. Looking for a portable gaming device that also lets you control your desktop computer remotely? The iPhone can do that.

The iPhone, however, is no longer your only option if you want a touch-screen, multi-function smartphone. So if you're not comfortable with AT&T Wireless, for whatever reason, you've got plenty of options.

Verizon Wireless is now countering the iPhone with a raft of touch-screen phones from Samsung, Research In Motion (nasdaq: RIMM - news - people ), HTC and others. T-Mobile carries both the G1, which is powered by Google's (nasdaq: GOOG - news - people ) Android operating system, and the Sidekick, a Web-savvy smartphone with a slide-out keyboard and a cult following that predates the iPhone.

Sprint (nyse: S - news - people ) will soon be selling the Palm Pre (see "Palm Strikes Back"). And there's more on the way, with a host of iPhone-inspired smartphones introduced at the Mobile World Congress in Barcelona this week.

The so-called netbook represents another alternative that has broken into the mainstream since the iPhone's launch. The tiny, low-cost notebook computers are selling fast, driving down the average selling price of computers across the entire PC industry. With a broadband data plan, one of these will still cost you less than an iPhone each month, yet a good netbook includes a user-friendly keyboard and much of the functionality you'll find in a personal computer.

ESPN International will have worldwide television rights to the IndyCar and Firestone Indy Lights series through the 2010 season under a two-year contract extension with the Indy Racing League.

The agreement announced Wednesday does not include coverage in the United States, where races are carried by ABC and VERSUS, or Brazil, where BAND TV has broadcast rights. The IRL and ESPN International will each have an option to extend the agreement another two years after 2010.



ESPN International owns more than 45 television networks outside the United States and is available in 201 countries and territories.

ESPN and ABC are owned by The Walt Disney Co. (nyse: DIS - news - people )

MOSCOW, Nov 22 (Reuters) - Russia's gas firm Gazprom wwould like to avoid supply cuts to Ukraine in 2009 but will not continue deliveries without a new contract, Gazprom's spokesman Sergei Kupriyanov said on Saturday.

Russia has often threatened to cut gas supplies during pricing disputes with Ukraine and has fulfilled the threat in early 2006, briefly halting supplies to Europe, 80 percent of which go via Ukrainian territory.

Gazprom said on Thursday Ukraine must repay a $2.4 billion gas debt before new supply contracts are signed, raising fears the two sides face another battle in their gas war.

"We would like to avoid such a scenario (this time). We have time to reach an agreement before the new year but as you understand we cannot supply gas without a contract," Kupriyanov told Vesti 24 television channel.

Ukraine's state energy firm Naftogaz said its debt to RosUkrEnergo, a Russian-Ukraine intermediary gas trader, co-owned by Gazprom, amounts to only $1.27 billion.

Kupriyanov said the Ukrainian side counted only Sept-Oct debt while Gazprom included November debt as well as penalties. He denied there were major differences in the overall debt estimates.

"Everybody understands pretty well who owes to whom and how much," Kupriyanov said.

Ukraine and Russia are engaged in talks on a 2009 price for gas, currently set at $179.50 per 1,000 cubic metres. Kupriyanov said a market price for 2009 gas deliveries was $400 per 1,000 cubic metres.

GAS BURNING IN FURNACES

A memorandum signed in October by Prime Ministers Vladimir Putin and Yulia Tymoshenko sees a gradual transition to market pricing and direct supplies without intermediaries such as RosUkrEnergo.

Kupriyanov said direct supplies as well as lower gas prices for Ukraine in 2009 were only possible if other conditions set out in the memorandum, such as debt redemption in full, were met. He said Russia would not discount for the global crisis.

"If Ukraine's consumption drops, our deliveries will fall as well but it is not happening. Gas is burning in furnaces of Ukraine's economy as it had been before, therefore the crisis has nothing to do with it," Kupriyanov said.

Gazprom supplies a quarter of Europe's gas needs and sends one fifth of its total exports via Belarus with the rest going via Ukraine, giving both countries extra leverage over the firm in pricing disputes.

Kupriyanov said Gazprom's financial standing was sound, debt portfolio "healthy" with the share of short term loans only 14 percent, while a revision of the capital investment plan will not concern priority projects such as the Nord Stream pipeline. "We can talk about not receiving some of expected profit (from domestic operations). The demand is falling, warm weather in November has also played a role," Kupriyanov said.

He said the firm was in intense talks with Belarus and Moldova to switch to rouble payments. Gazprom supplied 15.32 bcm of gas to Belarus at $128 per tcm in Jan-Sept 2008 and 1.9 bcm to Moldova.

With the Russian rouble under depreciation pressure as a result of falling prices for oil, Russia's main export commodity, Russia is seeking to boost international demand for roubles from its ex-Soviet neighbours.

"The rouble is the most reliable currency. Our expenditure is also in roubles. Matching our revenues and expenses is a reasonable thing," Kupriyanov said.

He added that the transition will require changes to contracts with Belarus and Moldova. He said Russia was not yet talking about switching to roubles with Ukraine but it was "theoretically possible". (Reporting by Gleb Bryanski, Editing by Peter Blackburn)
